Terms of Service

These Terms of Service govern the use of and access to the Kamzan service, the client software and the related websites and web services. By using Kamzan, you agree to be bound by these Terms, by the Privacy Policy and by the Acceptable Use Policy. As Kamzan is a B2B service, a user who is using Kamzan or its services on behalf of an organisation automatically accepts these Terms on behalf of that organisation.
Your files and your permissions
When you use our Service, you provide Kamzan with your files, content, email messages, contacts and other data, subject to your intrinsic approval expressed through the act of uploading and through the use of the individual applications within Kamzan. The files you upload to our service, that you share and that you use on our platform are your exclusive physical and intellectual property. These Terms grant us no rights over your files, except to the extent that a limitation of those rights is necessary in order to provide the service correctly.
To allow you to make the best use of Kamzan, to back up your data and to carry out operations relating to hosting management, we need your approval. Our Services offer features such as photo thumbnails, document previews, the addition of comments, and simple ways to sort, edit, share and search your files. These and other features may require our system to access, store and scan your files. You grant us permission to carry out these operations, and this permission extends to our affiliates and to trusted third parties with whom we collaborate, always in compliance with data protection by default and by design requirements under the European General Data Protection Regulation (GDPR).
Sharing content
Kamzan lets you share files with your colleagues, with the people who use the system and who are registered through their own specific account within the platform, and with other people outside the system through the generation of a public link and the sending of sharing emails. For greater security, you can set an expiry date for the sharing link, a password to access the shared files, and write, edit and read permissions for the files. It remains the user’s responsibility to verify with whom they are sharing and which files those people will be able to view, edit or delete.
User responsibility
As a user, you are responsible for your conduct and for your files, and you must comply with our Acceptable Use Policy. Likewise, you must respect copyright and authorship laws for files that are protected by the intellectual property rights of others. Do not copy, upload, download or share content unless you have the right and the permission to do so. Kamzan is not responsible for the content you upload to the platform or share through our service, but we reserve the right to review your conduct to ensure that it does not violate our Acceptable Use Policy.
Access to the platform
Access to the platform is subject to knowledge of strictly personal access credentials, namely a username and password.
- By accessing Kamzan, you provide Jinni S.r.l. with a series of information related to the account, such as IP address, date and time of connection, as well as the email address, first name and last name defined during account registration.
- The platform does not apply any block at login if more than one person accesses with the same account, even simultaneously.
- The platform attributes every single operation performed by an account to the account itself, and cannot provide information on the specific person if more than one person logs in with the same account.
- The user is therefore required to keep their access credentials in a safe place.
- The user must not share their access credentials with third parties, nor grant them access.
Software
Some of the services provided by Kamzan allow you to download and use software whose installation package signature may belong to Jinni S.r.l. or to its partners who developed the software for Jinni S.r.l. Provided that you comply with these Terms, Kamzan grants you a limited, non-exclusive, non-transferable and revocable licence to use such software, for the sole purpose of accessing the services. Under these Terms, you agree not to reverse-engineer or decompile the software, nor to attempt to do so or to help another person do so.
Responsibility of a document signer
As the signer of a document, called upon to perform this single function on the Kamzan platform by a user registered on it, you are responsible for your conduct, for the statements you make regarding your review of these Terms, and for the authorisation you hold to electronically sign the document for which a user registered on Kamzan has sent you the signature request. You must also comply with our Acceptable Use Policy. Likewise, you must respect copyright and authorship laws for files that are protected by the intellectual property rights of others. Kamzan is not responsible for the content you sign via electronic signature within the platform, even though it was sent to you through the platform itself. In any case, we reserve the right to review your conduct during the signing process to ensure that it does not violate our Acceptable Use Policy.
Authorisation to sign a PDF document by the signer
As the signer of a document, called upon to perform this single function on the Kamzan platform by a user registered on it, during the signing process you must declare, through a specific checkbox to be activated, that you are authorised to sign the document. This declaration is an integral and binding part of the signing procedure. In order to proceed with signing a document, you must therefore declare that you have “signing authority” (also known as “power of signature”). “Signing authority” consists of the legitimacy of a subject to sign legal deeds, thereby assuming obligations and acquiring rights in the name and on behalf of others. The date and time of your declaration — understood as the moment at which you activate the specific checkbox — together with other data necessary for the unique identification of the signing process and your IP address, will be saved by Kamzan.
Trial period
If you have been offered the possibility of using Kamzan or its associated services for a free trial period — which begins on the date the Kamzan instance and/or the service is activated and lasts a maximum of 14 calendar days — there will be no automatic conclusion of a contract between Jinni S.r.l. and the user enjoying the trial once the trial has ended. To request the Kamzan trial period, Jinni S.r.l. does not require any information regarding payment credentials or credit cards. The data requested is solely the minimum necessary to create a Kamzan instance and an Administrator-type account for the requester.
During the trial period the user has access to all the features of the service, except the integration with certified digital preservation; the blockchain timestamp credits and the electronic signature credits (whether SES, AES or QES) are not to be considered features. The user may create and activate users and use the storage space they need, within the availability that Jinni S.r.l. decides to grant the user for these specific items. At the end of the trial period the user may choose, without any obligation, whether or not to purchase Kamzan and/or the services for which the trial was carried out. In the event of purchase, the number of activated users, their type and the disk space required will define the economic value of Kamzan and/or the services; all files, folders, users, etc. uploaded during the trial period will also be retained. Otherwise, since you are the sole owner of the data, Kamzan will delete the users you created, together with all files, folders, etc., within 48 hours of the expiry of the 14th trial day, and will retain no backup copy of them.
Our Services
Kamzan and its related services are protected, in whole or in part, by copyright, trademarks and other intellectual property and authorship laws currently in force in Italy and in the European Union. These Terms grant no right, title or interest in Kamzan and its services, in the content produced by Jinni S.r.l. for Kamzan and its services, in Kamzan trademarks and logos, or in other features of the registered Kamzan trademark.
Copyright
We respect the intellectual property of others and ask you to do the same. We respond to notices of alleged copyright infringement, if compliant with the law and if communicated to us through copyright rules. We reserve the right to remove or disable content that represents alleged infringement and to terminate the accounts of repeat copyright infringers.
